Terms of Service

These terms cover work done by D’Amico Digital (“we”, “us”) for a client (“you”). Anything we agree in writing for a specific project overrides what is written here.
What we do
Website design and build, local SEO, Google Business Profile management, review management, Google Ads management, and social media management. What is included in your engagement is whatever plan you signed up for, plus any add-ons you asked for.
Pricing and billing
- Monthly plans are billed monthly in advance and run month to month. There is no minimum term and no cancellation fee.
- One-time builds are quoted before work starts and paid as agreed at the time.
- Add-ons such as ad management and social media are billed alongside your plan.
- Advertising spend is separate. Our Google Ads fee covers managing the campaigns. The money paid to Google is yours, billed to your own account, and is not included in the management fee.
Prices published on this site apply to new engagements. If we change them, existing clients get notice before it affects them.
Edits and turnaround
On monthly plans, we aim to have requested edits live within 48 hours of receiving them on a business day. That covers ordinary content and layout changes — new pages, new features, or a redesign are separate work and we will tell you before doing them.
One-time builds include edits for the first month after launch. After that, changes are quoted separately or you can move onto a monthly plan.
Who owns what
- One-time build: once it is paid for, the finished site is yours outright, including the source files.
- Monthly plan: the site is yours to use for as long as the plan is active. If you leave, we will hand over the site files. We are not obliged to keep hosting it.
- Content you give us — logos, photos, copy, product information — stays yours. You confirm you have the right to use anything you send us.
- We may show the finished work in our portfolio unless you ask us not to.
Hosting, uptime and security
Monthly plans include hosting, SSL and routine security maintenance. We use reputable infrastructure and keep things patched, but no one can promise a website will never go down. We do not offer a specific uptime guarantee, and we are not responsible for outages at upstream providers.
About rankings and results
This one matters, so it is in plain words: nobody can guarantee Google rankings, including us. We do the work that is known to move local rankings — profile optimization, consistent business details, reviews, and a site worth ranking — and we do it consistently. How Google responds, and how fast, depends on your category, your competitors, and algorithm changes none of us control.
The same applies to leads and revenue. Any results, timeframes or figures mentioned on this site, including client testimonials, describe what happened for that business. They are not a promise of what will happen for yours.
What we need from you
- Accurate information about your business, and the access we need to do the work — usually your Google Business Profile and domain.
- Timely answers and approvals. Long silences push timelines back.
- Confirmation that content you supply is accurate and that you have the rights to it.
Third-party platforms
Google, Meta, TikTok, X and similar platforms have their own rules and can change them, restrict features, or suspend accounts on their own terms. We work within those rules but we do not control them and are not responsible for their decisions.
Cancelling
Cancel a monthly plan any time by telling us. Your plan runs to the end of the period you have already paid for, and we do not pro-rate part-months. One-time build work already completed or in progress is payable.
Liability
We will do our work with reasonable skill and care. To the extent the law allows, our total liability for any claim connected to our services is limited to the amount you paid us in the three months before the claim arose, and we are not liable for indirect or consequential losses such as lost profits or lost business.
Governing law
These terms are governed by the laws of the State of Texas, and disputes belong to the courts of Lubbock County, Texas.
Changes
We may update these terms. The date at the top shows when they last changed, and material changes affecting existing clients will be communicated directly rather than posted quietly.
